We are honoured to have Dr. Rozaidi Razali, Governance, Integrity & Anti-Corruption Practitioner and Board Member of Institut Integriti Malaysia (IIM), sharing his valuable insights during our Adequate Procedures class.

The session provided participants with a deeper understanding of Section 17A of the MACC Act and the importance of implementing Adequate Procedures as a defence against corporate liability.

One of the key messages highlighted was that having an Anti-Corruption Policy alone is not sufficient. Organisations must be able to demonstrate that their policies are effectively communicated, implemented, monitored, and supported by appropriate controls and evidence.

The session also explored the T.R.U.S.T. Principles, emphasising the importance of top-level commitment, risk assessment, control measures, monitoring, and continuous training in building an effective anti-corruption framework.

Ultimately, good governance is not measured by what is written on paper, but by what is practised, monitored, and evidenced in reality.

Not all Politically Exposed Persons (PEPs) present the same level of risk.

Understanding PEP types and risk levels is crucial for effective AML/CFT compliance. From Foreign PEPs and Domestic PEPs to officials within International Organisations, each category requires an appropriate level of due diligence based on its risk exposure.

A risk-based approach enables organisations to:

• Focus resources effectively
• Strengthen internal controls
• Mitigate corruption and financial crime risks

By assessing PEPs according to their level of authority, influence, access to public resources, and exposure to corruption risks, organisations can apply proportionate monitoring and due diligence measures.

A strong risk-based approach supports:

✓ Trust & Good Governance

It is important to remember that PEPs are not automatically involved in wrongdoing. However, their positions may expose them to higher risks, making effective screening, monitoring, and due diligence essential components of a robust AML/CFT framework.

⚖️ Today’s session at AMLAC Academy focused on 𝐒𝐞𝐜𝐭𝐢𝐨𝐧 𝟏𝟕𝐀 𝐨𝐟 𝐭𝐡𝐞 𝐌𝐀𝐂𝐂 𝐀𝐜𝐭, highlighting how commercial organisations may be held liable for corrupt acts committed by associated persons, including directors, employees, and agents. 📚

The session also shared plausible scenarios and case studies involving bribery, gratification, and 𝐜𝐨𝐫𝐩𝐨𝐫𝐚𝐭𝐞 𝐥𝐢𝐚𝐛𝐢𝐥𝐢𝐭𝐲 under Section 17A. Participants gained clearer insight into how corruption risks involving agents or consultants may expose companies to 𝐬𝐞𝐫𝐢𝐨𝐮𝐬 𝐥𝐞𝐠𝐚𝐥 𝐜𝐨𝐧𝐬𝐞𝐪𝐮𝐞𝐧𝐜𝐞𝐬.

The discussion further highlighted the importance of 𝐩𝐫𝐨𝐚𝐜𝐭𝐢𝐯𝐞 𝐜𝐨𝐦𝐩𝐥𝐢𝐚𝐧𝐜𝐞 and the legal penalties that may arise from corruption-related offences under the law.
