Qn. What types of environmental study are conducted in Nepal? How do you identify the types of environmental study for energy sector projects?
Ans:-
1st Part:
Environmental study or assessment is mandatory for every development project in Nepal. Currently, Environment Protection Act, 2076 and Environment Protection Regulations, 2077 are in existence for the conduction of environmental study in Nepal. Many projects are implemented every year by government, private sector and public sector. All of them do not need to go through EA process. Screening can be defined as preliminary activity undertaken to classify level of environmental study that requires for given proposals. There are three level of environmental study as per EPA2076/EPR2077 of Nepal, they are Brief Environmental Study (BES), Initial Environmental Examination (IEE) and Environmental Impact Assessment (EIA).
According to Rule 3 (Sub Rule 1) of the Environment Protection Regulations, 2020, Brief Environmental Study, BES should be carried out by the Proponent for the Proposals mentioned in the Schedule-1, Initial Environment Examination, IEE should be carried out by the Proponent for the Proposals mentioned in the Schedule-2, and Environmental Impact Assessment, EIA should be carried out by the Proponent for the Proposals mentioned in the Schedule-3 based on the nature and scale of the Proposals.
2nd Part: Under EPR 2020 Section 6 Energy, Water Resources, and Irrigation Sector of Schedule 1, 2 and 3 environmental study for energy sector projects can be discussed as:
Brief Environmental Study (BES)
i. Use of forest land for power transmission lines up to 66 kV.
ii. Generation of electricity from magnetic energy.
iii. Use of forest land for establishing hydrological and meteorological measurement centers or weather radar installations.
iv. Construction of lift irrigation projects covering up to 100 hectares.
Initial Environmental Examination (IEE)
i. Construction of electricity transmission lines with a capacity of 132 kV or higher.
ii. Construction of a new outdoor substation by tapping from an existing electricity transmission line of 220 kV or higher capacity.
iii. Construction of hydropower generation projects with a capacity ranging from 1 MW to 50 MW.
iv. Operation of electricity generation projects using petroleum or gas with a capacity ranging from 1 MW to 5 MW.
UNDER Renewable Energy Sector
v. Operation of solar energy-based electricity generation projects with a capacity ranging from 1 MW to 10 MW.
vi. Operation of wind energy-based electricity generation projects with a capacity ranging from 1 MW to 10 MW.
Environmental Impact Assessment, (EIA)
i. Construction of a multipurpose reservoir.
ii. Operation of coal-based or nuclear power generation projects.
iii. Construction of hydropower generation projects with a capacity exceeding 50 MW.
iv. Operation of electricity generation projects using petroleum or gas with a capacity exceeding 5 MW.
UNDER Renewable Energy Sector
v. Operation of solar energy-based electricity generation projects with a capacity exceeding 50 MW in hilly regions and exceeding 40 MW in the Terai region
vi. Operation of wind energy-based electricity generation projects with a capacity exceeding 10 MW.
