🦅 ကျနော်တို့ Myanmar Center, USIRD INC အနေနဲ့ ပါဝင်အားဖြည့် ကြီးကြပ်ပေးထားတဲ့ 39 Country Mass Action Lawsuit against USCIS တရားစွဲဆိုမှုအပေါ် Massachusetts ပြည်နယ် Federal Court တရားသူကြီး Judge Kobick မှ “USCIS ၏ Adjudicative Hold Policy ဟာ တရားမဝင်ကြောင်း” ဆုံးဖြတ်အမိန့်ထုတ်ခဲ့ပြီး မြန်မာနိုင်ငံသားများ အပါအဝင် တရားလို များစွာအတွက် ကနဦးတားမြစ်မိန့်ဖြင့် ၂၀၂၆ ဧပြီလမှာ ကနဦး ဖြေလျှော့မှု ပေးခဲ့ပါတယ်။

🏛️ ယနေ့မှာ အဆိုပါ ဆုံးဖြတ်ချက်ကို ကိုးကားပြီး Rhode Island Federal Court မှလည်း "USCIS က Case တချို့ကို ရပ်ထားတဲ့ Policy တွေဟာ ဥပဒေနဲ့ မကိုက်ညီဘူး" လို့ Dorcas International Institute of Rhode Island v. USCIS မှာ ထပ်ဆင့်ဆုံးဖြတ်ခဲ့ပါတယ်။ ထို့အပြင် တရားရုံးက အဲဒီ Policy တွေကို ဖျက်သိမ်းဖို့လည်း အမိန့်ချခဲ့ပါတယ်။

✅ အဆိုပါ စီရင်ချက်ဟာ USCIS မှာ Asylum, TPS, EAD, Adjustment of Status (Green Card), ဒါမှမဟုတ် အခြား Immigration Benefit Case တွေ Pending ဖြစ်ပြီး Case Hold ခံနေရတဲ့သူတွေအတွက် အားတက်စရာ Update တစ်ခု ဖြစ်ပါတယ်။

✅ တရားရုံးရဲ့ အဓိက အကြောင်းပြချက် ကတော့ USCIS မှာ ဒီလို case တွေကို Policy Memo နဲ့ ရပ်တန့်ထားဖို့ တရားဝင် အခွင့်အာဏာ မရှိဘူးဆိုတာပါပဲ။ USCIS က Adjudication တွေကို Pause လုပ်ထားတာဟာ ဥပဒေနဲ့ မညီဘူးလို့ တရားရုံးက တွေ့ရှိခဲ့ပါတယ်။

✅ ဒီဆုံးဖြတ်ချက်ဟာ အင်မတန်မှ အားတက်စရာ ကောင်းလှပါတယ်။ ဘာကြောင့်လဲဆိုတော့ တရားရုံးက လျှောက်ထားသူတစ်ယောက်ချင်းစီအတွက် Order ပေးတာမဟုတ်ဘဲ၊ Trump အစိုးရအဖွဲ့ရဲ့ လက်ယာယိမ်း အစွန်းရောက် စိတ်လိုက်မာန်ပါ အမိန့်ထုတ်ပြန်ချက်ဟာ ဥပဒေနဲ့ တက်တက်စင်အောင် လွဲချော်နေတယ်ဆိုတာကို ဖော်ပြလိုက်တာကြောင့်ပဲ ဖြစ်ပါတယ်။

✅ Adjudication Pause Policy ကို တရားမဝင်ဘူးလို့ တရားရုံးက မိန့်တာဟာ အရေးကြီးတဲ့ အရွှေ့အပြောင်း တစ်ခုပါ။ ဒါပေမဲ့ USCIS ကို Individual Case တွေမှာ တကယ် Action ယူလာစေဖို့တော့ Continued Pressure လိုနေပါသေးတယ်။

✅ USCIS Case Hold, Delayed Adjudication, EAD Delay, TPS-related Issue, Asylum Delay, ဒါမှမဟုတ် Adjustment Delay ကြုံနေရတဲ့သူတွေက ကိုယ့် Case အခြေအနေကို သေချာစစ်ဆေးသင့်ပါတယ်။ USCIS Notice တွေ၊ Deadline တွေ၊ Court Order တွေ၊ Legal Option တွေကိုလည်း သတိထားပြီး Follow Up လုပ်သင့်ပါတယ်။

Exciting News on Our Multi-Plaintiff Lawsuit!

On April 30, The US District Court of Massachusetts ruled in favor of the 197 plaintiffs who sued USCIS as a part of Hacking Immigration Law’s multi-plaintiff litigation lawsuit. Judge Kobick initially granted the 22 plaintiffs’ request for a preliminary injunction.

This week, the ruling has been extended to cover all plaintiffs who were part of the case. This will temporarily halt the government order from enforcing the USCIS freeze while the lawsuit continues.

The adjudicative hold policy that paused final decisions on specific immigration applications was ruled against.

The court also found the government’s “significant negative factor” policy unlawful as it related to specific nationalities.
At the moment, the ruling only applies to the 197 plaintiffs in the case, but Hacking Immigration Law is preparing a second multi-plaintiff litigation lawsuit in the coming weeks, with a deadline to register on Wednesday, May 13.

လုပ်ကိုင်သွားရန် အမိန့်ချမှတ်လိုက်တာ ဖြစ်ပါတယ်။

✅ ဒါဟာ ပိုမိုကြီးမားတဲ့ တရားမျှတမှုတိုက်ပွဲထဲက အင်မတန်မှအရေးကြီးလှတဲ့ ခြေလှမ်းတစ်ရပ်ဖြစ်ပါတယ်။ ကျန်ရှိနေတဲ့ တရားလိုများအတွက်သာမက အမေရိကန် တစ်နိုင်ငံလုံးခြုံငုံတဲ့ Nationwide Relief ဖြေလျှော့မှုရရှိဖို့ ကျွန်တော်တို့ ဆက်လက်ပူးပေါင်း ကြိုးစားနေပြီး နောက်တဆင့်အနေနဲ့ ဒီအမှုမှာ ပါဝင်ထားတဲ့ တရားလို ၁၉၇ ဦးစလုံးအတွက် အပြုသဘောဆောင်တဲ့ ဆုံးဖြတ်ချက်တစ်ခု ရရှိစေရန် ရှေ့ဆက်လုပ်ဆောင်နေပါတယ်။
