Judge blocks Trump’s $100,000 H-1B visa fee: What does this mean for H-1B applicants and employers?
On June 8, 2026, a federal judge vacated the Trump administration’s $100,000 H-1B visa fee policy.
The fee mainly affected certain H-1B petitions involving workers outside the U.S. seeking to enter on H-1B status.
The court found that the policy violated the Administrative Procedure Act and the U.S. Constitution, ruling that the payment functioned more like a tax that Congress had not authorized the executive branch to impose.
🎯 Current Status
For now, the $100,000 H-1B fee is not currently enforceable. This is a major relief for employers and foreign workers who were worried that the high fee could make H-1B sponsorship much harder.
However, the case is not fully over yet because the Trump administration plans to appeal.

How Hard Is It to Get Into a Day-1 CPT Doctoral Program?
Thinking about a Day-1 CPT doctoral program but worried it’ll be too hard to get in?
not all doctoral programs have the same admission difficulty. Some are faster and more flexible, while others require stronger work experience or more materials.
📌 One thing many students misunderstand: Doctoral programs usually do NOT require publishing papers in academic journals. But you should still expect research projects, writing-intensive coursework, or dissertation/ capstone requirements
• Around 6 credits per semester at many schools
Here’s a quick breakdown 👇
📍 Westcliff University (DBA)
Often considered one of the more accessible options
• GPA requirement: around 2.5+
• No SOP required
• Faster admissions timeline compared to many doctoral programs
Good fit if:
✔️ You need a faster timeline
✔️ You want a simpler application process
📍 Sofia University
More materials, but still relatively accessible
Requirements may include:
• Personal statement
• Business / leadership background
• Three recommendation letters
Good fit if:
✔️ You have stronger professional experience
✔️ You don’t mind preparing more materials
📍 Trine University (DIT)
More specialized requirements:
• Stronger technical / CS background preferred
• Recommendation letters required
• Program fit matters more
Good fit if:
✔️ You work in tech / IT / engineering
📍 Ottawa University
Requirements: Typically ~5 years of work experience preferred
Good fit if:
✔️ You have a longer professional background
📍 National Louis University (DBA)
Requirements: Around 3 years of full-time work experience required
Good fit if:
✔️ You already have established work experience
📍 University of the Cumberlands
Things to consider:
• Admissions timelines may be longer
• GPA around 3.0 is commonly preferred but requirements vary

Should You Choose a Day-1 CPT Master’s or Doctoral Program? 👀
If DHS eventually makes second master’s pathways harder, many students may start looking at doctoral programs instead. Will there still be enough spots when you need one?
Doctoral programs usually have: fewer seats, stricter admissions, longer review timelines and fewer school options
That means waiting until your status is close to expiring could leave you with fewer choices.
🌟 Day-1 CPT Master’s Program
Typically best if you:
✔️ Need a faster status solution
✔️ Want lower upfront costs
✔️ Only need another 1-2 H-1B attempts
✔️ Prefer shorter programs (usually 1-2.5 years)
✔️ Want more school options
Common programs include:
• MBA
• MS Business Analytics
• MS Computer Science
• Data / IT programs
🌟 Day-1 CPT Doctoral Program
Typically best if you:
✔️ Already have one or multiple master’s degrees
✔️ Need a longer timeline for H-1B planning
✔️ Want a clearer academic progression
✔️ Need more lottery opportunities over time
✔️ Want to reduce concerns around repeated degree levels
Doctoral programs are usually:
• 2-5 years
• More reading/research heavy
• Most programs require a dissertation, capstone, or applied research project, but its don’t require to publish paper
• Unfortunately it is not fully funded as traditional PhD
Common options:
• DBA
• DIT
• Leadership / Technology doctorates
⚠️ Be more cautious with another master’s if:
• You already completed multiple master’s degrees
• The new major is very similar to your previous degree
• Your degree has weak job relevance
• Your academic path looks repetitive instead of progressive
In these situations, a doctoral program may sometimes create a stronger academic narrative.

OPT Expiring Before H-1B Starts? Here’s How Cap Gap Works 👇
H-1B status doesn’t officially begin until October 1 each year.
But for many students, OPT expires during the summer. That gap between OPT expiration and H-1B activation is called the “Cap Gap.”
💡 What does Cap Gap do?
Cap Gap can automatically extend:
✔️ Your F-1 status
✔️ Your work authorization (for eligible students)
This helps certain students stay and continue working in the U.S. without:
• stopping work
• leaving the country
• rushing into another status option
BUT Not every F-1 student qualifies automatically. You generally must meet ALL requirements listed in slides
Also your Cap Gap benefits depend heavily on WHAT stage of F-1 status you were in when the H-1B petition was filed. This is where many students get confused.
