A woman talked to her therapist about her marriage, her finances, her fears about supporting her family. Two years later, every word she typed was subpoenaed and read in court by her former employer.

It already happened. And it is not just a Talkspace problem.

In the latest episode of Starting a Counseling Practice Success Stories, we get into the Kamrass v. AdventHealth case and what it means for the rest of us: why therapist-client privilege does not protect what you think it does, why "HIPAA compliant" is more marketing than protection, how anonymized transcripts get de-anonymized, and what it means that these platforms are training AI on millions of real therapy conversations.

It is not all alarm. We also walk through what you can actually do: rethinking informed consent, reading the terms most of us click past, and becoming a real guardian of your clients' data.

Two weeks out.

You don't have to adopt a single AI tool to be on the hook for one.

Your practice management system, biller, clearinghouse, or telehealth platform can switch on an AI feature in a routine update. And AMHCA, NBCC, ACA, and APA ethics guidance already say: if AI touches your work, you're responsible for understanding it and protecting your clients' data.

Starting a private practice with a business partner. It is a question we get a lot, and the answers are rarely simple.

In our newest episode, Kelly sits down with Allison and Amanda, two LPCs who left insurance-panel group practice work to build their own specialized practice in Dallas, together. Three years in, they run a couples and trauma-focused group practice with distinct niches, a shared brand, and a partnership that actually works.

They get into the real stuff: why they chose partnership over going solo, the four months of weekends spent building the practice on the side, how they learned SEO from scratch, the mistakes and the overwork, what it takes to stay regulated when your numbers dip, and what they tell people who say they want to start a business with a friend.

If you are sitting with the question of whether to start, whether to niche, whether to partner up, or whether now is even a good time to build a practice (spoiler: it is), this conversation is for you.

May 20: Aetna cuts extended sessions and psychologist reimbursements through Alma.

May 28: Aetna announces "Aetna Mental Health on Demand" - launching January 2027.

8 days apart 🚨

The new platform: Single-session intervention model. AI tools. Predictive analytics. They bragged about 13-second clinician response times.

Let's connect the dots:
1️⃣ Stop paying for extended sessions
2️⃣ Cut specialist rates to match generalist rates
3️⃣ Launch an AI-assisted single-session alternative

If you wanted to make relationship-based therapy too expensive to deliver, then offer a faster, cheaper substitute - this is what that looks like.

The predictive analytics will flag members "at risk of future inpatient admission." When the model gets it wrong, we carry the clinical liability. Not them. They hold the data. We hold the risk.
We're not against access. We're against surveilled substitutes for the care that actually helps people.

Watch what they build. Not what they say.

therapists get sick, get hurt, and die, and when it happens, someone has to call the clients, secure the records, and close the practice, often while grieving.

most of us don't have a plan for that. not because we don't care, but because thinking about it means thinking about our own mortality, so we put it off.
our latest guest post is from Robyn Miller, Ph.D., founder of TheraClosure, who has stepped in as a practice executor twice for colleagues. she shares what she learned the hard way, and lays out what every therapist should have in place before they need it: a professional will, a chosen executor, detailed access instructions, and knowledge of your state's record-retention rules.

a professional will isn't morbid paperwork. it's infrastructure, same as your fees, your contracts, and your insurance. a practice that can survive a bad week or a bad diagnosis is one you've actually built.

Maybe you've started using an AI tool in your practice. Maybe you've decided you never will.

Either way, the decision to have an AI policy isn't fuEither way, the decision to have an AI policy isn't fu yours anymore.

Your practice management system, biller, clearinghouse, or telehealth platform; any one of them can flip on an AI feature in a routine update, with a notice that's easy to miss. And the standard is already set: AMHCA, NBCC, ACA, and APA ethics guidance all point the same direction. If AI touches your work, you're responsible for understanding it and protecting your clients' data.

That obligation exists right now. What most of us don't have is a policy solid enough to stand behind if a vendor changes the rules overnight.

On Tuesday, June 30 at 10am Pacific, Dr. Maelisa McCaffrey is going to help you build one. Live, 90 minutes, free. You'll leave knowing what an AI policy actually is (and isn't), how to evaluate AI tools, what to tell clients, and how to stay HIPAA-compliant; no legal degree or tech expertise required.

The therapists who've sworn off AI? Often the most exposed to a quiet vendor update. This one's for you too.

hiring a private practice consultant can be a "why didn't I do this sooner?" decision. it can also be a "why did I pay to feel confused and mildly gaslit?" decision. both happen to smart therapists.

the consulting world has genuinely excellent, ethical people in it. it also has a loud corner where confidence gets built out of hype and marketing sparkle. so we wrote down nine red flags to help you tell the difference: guaranteed income numbers with no mention of ethics, one-method gospel, "I did it once so I can teach you," dependency culture, undisclosed affiliate bias, and more.

a red flag isn't a verdict on someone's character. it's a mismatch warning. your job is to protect your time, money, nervous system, and business. discernment, not judgment.

The therapist union you're hoping for? It's not coming 🚨

We know that's hard to hear. But it's important to understand WHY - so you can stop waiting and start moving.

Here's the structural reality: You're not an employee of Aetna or Alma. No employment relationship means no bargaining unit. No bargaining unit means no union to organize.

And here's what most people don't realize: A room full of independent practice owners agreeing on rates isn't a union. It's price fixing. That's a real antitrust problem - and exactly why professional associations won't touch fee issues.

Even when associations do advocate, they work on policy timelines measured in years. Alma changed hands in May. Rates were cut by July. Policy can't move that fast.

So what CAN you do?

You can't make Aetna pay more. You can't unionize against a company you don't work for.

But you CAN leave a panel. You CAN set your own fee. You CAN own your referral pipeline so no platform controls your practice.

Mass exodus is the union. It always was.

The cuts keep happening because enough therapists stay. The only message payers actually read is therapists leaving. Not petitions. Not emails. Departures.

You have more leverage than you've been led to believe.

Hiring a therapist consultant is a lot like hiring a hiking guide. You could figure out the trail alone... or you could skip the part where you pack the wrong snacks and end up on a cliff waiting for a tiny helicopter.

Most therapists tell us they "just need marketing." Sometimes that's true. But just as often the real issue is a fee structure that doesn't match reality, a schedule that's quietly wrecking your nervous system, or systems leaking time all over the place. Marketing a practice that undercharges and overbooks you isn't worth the effort; you'd just fill a practice that depletes you.

We broke down the five reasons therapists actually reach out for support, from "I'm starting and I don't want to build this the hard way" to "I'm full and still not okay." Good chance you're sitting in one of them right now.

Want to go viral as a therapist? Here's how 📈

Get great clinical outcomes.

Yes, it's fun to go viral on social media. Lots of likes, traffic, visibility. But that's not what we're really talking about.

We're talking about doing clinical work so good that people's lives are changed forever.

That's legacy work.

People notice the changes in your clients. Their family notices. Their friends notice. And they start asking: Who's your therapist?

You get known in your community for doing exceptional clinical work. Referrals come because the results speak for themselves.

That's the kind of viral we want as clinicians.

Not vanity metrics. Transformed lives.
